Legal options for value extraction

At a time when local authority coffers are running low, local authorities are seeking ways and means to improve their financial situation. For this reason, there has been debate for many years now regarding the recapture of value increases resulting from town planning. However, the federal government decided against introducing legislation that would enable local authorities to recapture such value increases in order to finance other urban development measures. Political decisions can also lead to an increase in land value. For instance, the decision to close Berlin Tegel Airport already led to an increase in the value of the surrounding land. This paper first presents various survey and analysis methods that examine the impact of aircraft noise on the property market. The noise impact studies are evaluated and compared with one another. Subsequently, the possibilities and limitations of value compensation offered by the established instruments of special urban planning law and urban planning contracts are highlighted, and an analysis is conducted to determine whether value increases resulting from noise reduction can be captured.
